As of May 20, 2025, the U.S. Equal Employment Opportunity Commission (EEOC) has officially opened the 2024 EEO-1 Component 1 data collection. Employers should note that the filing deadline is Tuesday, June 24, 2025, and the EEOC has made it clear that no extensions will be granted this year. The announcement includes this firm statement:

“The collection period will not extend beyond the Tuesday, June 24, 2025 ‘Published Due Date’ deadline.”

To submit your data, visit the official reporting site.

What's New This Year?

Changes to Reporting Non-Binary Employees

Unlike in previous years, employers can no longer exclude non-binary employees from the primary report and file them separately. Instead, they must now be classified within the existing framework using alternate methods. Be sure to review your internal policies and prepare for this change accordingly.

Changes to Reporting Non-Binary Employees

Both the instruction booklet and the online filing system continue to state that federal contractors with 50–99 employees are required to file the EEO-1. However, Executive Order (EO) 11246, which served as the legal basis for that requirement, was rescinded in January 2025, and its implementing regulations are no longer in effect.

This raises important questions about whether contractors in that 50–99 employee range are still obligated to file. If your organization falls into this group, we strongly recommend consulting with your legal counsel and speaking with Ellen Shong & Associates for further guidance.
