State EEO Requirements Tracker

Ellen Shong & Associates monitors and provides services on equal employment opportunity (EEO) and affirmative action (AA) requirements that states have for employers.

State Contractors EEO Requirements, State Pay Transparency Laws, and State Pay Reporting Laws

We have seen increased complexity in requirements from the states in the following areas:

  • EEO and AA requirements for employers with state contracts

  • Pay transparency laws regarding applicants and employees

  • Pay reporting laws that require employers to submit pay data on employees

The landscape varies significantly by state. While some states impose limited requirements in one or more of these three areas, other states have enacted extensive and burdensome requirements. In addition, certain cities and other local units of government have adopted their own requirements.
 

The chart below shows the states that currently have EEO requirements for contractors and other employers. Compliance obligations can differ based on employer size, location, and contractual relationships. It is essential to understand the full scope of your responsibilities.
