EEOC Materials on Discrimination Against American Workers

On November 19, 2025, the Equal Employment Opportunity Commission (EEOC) released new materials on discrimination against American workers. In an announcement on the agency's website, EEOC stated that the following materials are available:



EEOC's announcement indicated that the agency's new materials reflect EEOC chair Andrea Lucas' priority to confront unlawful anti-American national origin bias. Chair Lucas has identified the prevention of discrimination against American workers as a "significant and ongoing focus for the agency’s compliance efforts, enforcement work, and litigation." According to Chair Lucas, "Many employers have policies and practices preferring illegal aliens, migrant workers, or non-immigrant guest workers (guest worker visa holders) over American workers."


In its document "Discrimination Against American Workers Is Against The Law," EEOC has identified the following employment subjects where discrimination may be occurring:


  • Job advertisements that show preferences for foreign nationals

  • Disparate treatment regarding terms, conditions, or privileges of employment such as situations where an employer makes it easier for foreign nationals to apply for openings

  • Harassment based on national origin

  • Retaliation against an individual for opposing national origin discrimination at work


In the announcement from EEOC, Chair Lucas stated that "Nothing justifies illegal national origin discrimination — whether rooted in cost of labor, customer preferences, or stereotypes.” The announcement encourages employees or job seekers who believe they have been subject to national origin discrimination to file a charge with the agency.
