EEO-1 Reporting Opens Soon; AAP Certification Status; California Pay Reporting Deadline

EEOC’s 2024 EEO-1 Reporting Website Opens May 20, 2025 with Deadline June 24, 2025

According to the EEOC’s 2024 EEO-1 Component 1 Instruction Booklet, the data collection portal is expected to open Tuesday, May 20, 2025, and will close Tuesday, June 24, 2025. This creates a tight five-week window for employers to submit their reports.


While the EEOC has occasionally allowed late filings in the past by keeping the portal open beyond the official deadline, this is never guaranteed. Keep in mind that filing can only begin once the portal is officially open, and the dates listed in the Instruction Booklet are subject to change.


To stay on track, plan to complete your filing well before the June 24 deadline.


In January 2025, Executive Order 11246 and its implementing regulations (41 CFR 60-1 and 60-2) were officially rescinded. As a result, federal contractors with 50–99 employees may no longer be required to file the EEO-1 report.


However, the current EEOC Instruction Booklet still states that this group must file, creating potential confusion. If you fall into this category, we recommend discussing your filing obligations with legal counsel or reaching out to Ellen Shong & Associates for clarification.


What is going on with the OFCCP’s AAP Certification?

Each year, the Office of Federal Contract Compliance Programs (OFCCP) typically requires contractors to certify their Affirmative Action Programs (AAPs) through an online portal. In 2024, the portal opened on April 1.


However, there has been no communication to the public or to contractors from the OFCCP regarding when or if the certification will be required for 2025. Given the current uncertainty regarding OFCCP employees, offices, and operations, it is possible that no certification will be required this year, especially since changes would be necessary to the contractor portal certification statements due to the revocation of EO 11246. If one tries to go to the contractor portal website from last year, the message returned is “Page Not Found.”



California Pay Reporting Deadline May 14, 2025
