New Executive Order Revokes EO 11246 for Women & Minorities Affirmative Action Programs

On January 21, 2025, President Trump signed a new Executive Order (EO) titled “Ending Illegal Discrimination and Restoring Merit-based Opportunity.” This order introduces significant changes, especially for federal government contractors, with wide-ranging implications for compliance and reporting obligations.
Key Change: Revocation of Executive Order 11246
The most notable provision in this new Executive Order is the revocation of Executive Order 11246, which has long required federal contractors to develop and maintain Affirmative Action Programs (AAPs) for women and minorities.
As a result, contractors will no longer be required to prepare or maintain AAPs for these two groups. However, there is a 90-day grace period for compliance, which extends through April 21, 2025. Contractors should use this time to reassess their internal policies and documentation.
What Remains in Effect?
It’s important to note that affirmative action obligations for Protected Veterans and Individuals with Disabilities remain unchanged. Contractors are still required to prepare and maintain AAPs for these two groups in compliance with existing regulations.
Additionally, the following reporting requirements are not affected by the new Executive Order:

VETS-4212 Report
State Affirmative Action Reports (as applicable)
DEI Programs May Also Be Impacted
The Executive Order also includes language addressing Diversity, Equity, and Inclusion (DEI) practices, both in the public and private sectors. While the specific guidance is still evolving, federal contractors should keep an eye on how this may influence internal DEI initiatives moving forward.
