OFCCP Extends Comment Period on Regulatory Changes

The Office of Federal Contract Compliance Programs (OFCCP) has extended the comment period on several recently proposed regulatory changes. These proposed regulatory changes affect all three of the laws that OFCCP has traditionally enforced. The agency will take comments until September 17, 2025 on these changes. The original end date for submission of comments was September 2, 2025.


OFCCP is proposing the following changes:


  • A rescission of all regulations that implement Executive Order (EO) 11246. EO 11246 was revoked in January of 2025 by EO 14173.

  • Removal of all recording requirements and other changes associated with the Section 503 of the Rehabilitation Act of 1974. Section 503 requires federal contractors to make efforts to employ and prevent discrimination against individuals with disabilities.

  • Minor changes associated with the Vietnam Era Veterans Readjustment Assistance Act (VEVRAA). VEVRAA requires federal contractors to make efforts to employ and prevent discrimination against certain classes of veterans.

The most significant changes proposed by OFCCP may be the Section 503 changes. These changes would effectively eliminate all statistical elements of affirmative action plans for individuals with disabilities.


Budget documents from the Trump administration suggest that OFCCP will be eliminated in federal fiscal year 2026 which begins on October 1, 2025. Thus, it is unclear what will happen to OFCCP's regulatory proposals. Federal contractors will be required to meet their obligations under Section 503 and VEVRAA regardless of OFCCP's status unless these laws are rescinded.
