OFCCP Extension of Data Collection Requirements

On April 23, 2026, the U.S. Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) requested an extension of current data collection requirements for the two laws that the agency enforces. These laws are Section 503 of the Rehabilitation Act (Section 503) and the Vietnam Era Veterans Readjustment Assistance Act (VEVRAA). OFCCP made its request for this extension to the Office of Management and Budget (OMB). OMB will accept comments on OFCCP's request until May 26, 2026. OFCCP has provided supporting statements to OMB regarding the Section 503 and VEVRAA data collection and reporting extension.
OFCCP had proposed to make revisions to its regulations under Section 503 and VEVRAA in July of 2025. OFCCP's July 2025 proposal would make major changes to the Section 503 data collection and reporting provisions for individuals with disabilities. There are only minor proposed changes to the VEVRAA regulations regarding data collection and reporting provision for veterans. As of May 13, 2026, the agency has not released a final version of these regulatory modifications.
The current data collection and reporting requirements associated with Section 503 and VEVRAA were set to expire on April 30, 2026. However, the site for OMB's Office of Regulatory and Information Affairs shows that the data collection requirements for both Section 503 and VEVRAA were extended through May 31, 2026. The extension through May 31, 2026 also applies to the disability self-identification form which federal contractors are required to use. This form also had an expiration date of April 30, 2026.
It seems likely that OMB will continue to do a monthly extension of OFCCP's data collection requirements until one of three things happens:
OFCCP's request to modify its Section 503 and VEVRAA regulations are approved and OFCCP forwards a new data collection request to OMB;
OFCCP postpones its proposed regulatory changes and OMB approves a longer extension to the current data collection requirements; or
OFCCP's activities are transferred to another agency within the federal government and an approval of OFCCP data collection requirements is no longer necessary.
The Trump administration has proposed to eliminate OFCCP and move the agency's responsibilities to a new agency within the Department of Labor for federal fiscal year (FY) 2027. FY 2027 begins on October 1, 2026. The administration had similarly proposed to eliminate OFCCP for FY 2026, but this proposal was not adopted by Congress. It is not clear what will happen in coming months with OFCCP and its data collection activities.
