On August 21, 2026, OFCCP released final versions of major changes the agency is making to the regulations for the laws the agency enforces. The most significant changes involves the regulations regarding the law that requires federal contractors to take affirmative action to employ individuals with disabilities. The changes to the agency's regulations will become effective on September 21, 2026.

The portal that the Veterans Employment and Training Administration uses for its VETS 4212 reporting is now open. Employers with a federal contract or subcontract of $200,000 or more must file the VETS 4212 report. Instructions for filing the report are found on the VETS 4212 website. Employers have until August 31 to complete this annual reporting.

Federal contractors have certain reporting obligations. Under the Trump administration, these obligations are changing. (1) The AAP certification required by OFCCP is on hold. (2) EEOC has plans to rescind the collection of EEO-1 reports . (3) OFCCP is not collecting AAPs or other information from contractors. (4) The only unchanged reporting requirement involves the VETS-4212 report.

The Federal Acquisition Regulatory (FAR) Council has proposed a new information collection under Executive Order 14398. The FAR Council proposal was submitted to the Office of Management and Budget on May 6, 2026. The public has until July 6, 2026, to comment on the proposed information collection.

The Office of Federal Contract Compliance Programs has received an extension on use of the agency's disability self-identification form. The form has been extended for use through May 31, 2026 and is likely to receive additional extensions.

The Office of Federal Contract Compliance Programs has requested an extension of current data collection requirements for the two laws that the agency enforces. These laws are Section 503 of the Rehabilitation Act and the Vietnam Era Veterans Readjustment Assistance Act. The Office of Management and Budget will accept comments on OFCCP's request until May 26, 2026.

The form that the Office of Federal Contract Compliance Programs requires federal contractors and subcontractors to use to gather information on disability status expires in April of 2026. The Office of Management and Budget has only approved the use of the form until April 30, 2026. Federal contractors and subcontractors should consider what steps to take in light of the expiration of this form.

The Trump administration's budget for federal fiscal year 2027 proposes to eliminate the Department of Labor's Office of Federal Contract Compliance Programs (OFCCP). The budget proposal would move OFCCP's responsibilities to a new Office of Civil Rights within the Department of Labor.
