The portal that the Veterans Employment and Training Administration (VETS) uses for its VETS 4212 reporting is now open. Employers with a federal contract or subcontract of $200,000 or more must file the VETS 4212 report. Instructions for filing the report are found on the VETS 4212 website. Employers have until September 30 to complete this annual reporting.
The VETS 4212 report has been used by the Office of Federal Contract Compliance Programs (OFCCP) during compliance reviews of federal contractors and subcontractors who are subject to the Vietnam Era Veterans Readjustment Assistance Act (VEVRAA). OFCCP does not formally administer the submission of the VETS 4212 report. However, OFCCP has in the past requested an employer's VETS 4212 report as part of the initial submission of information at the start of a compliance review.
The regulations regarding the VETS 4212 report state that employers with a federal contract or subcontract of $100,000 or more must file the report. However, VETS 4212 reporting is subject to the federal statutory provisions that index certain reporting thresholds to inflation. As of October 1, 2025, the monetary thresholds for VETS 4212 reporting and for requirements under VEVRAA were increased to $200,000. The VETS 4212 site inaccurately states that the monetary threshold is $150,000.
The reporting period for the VETS 4212 report is the 12 months preceding a selected payroll period end date. VETS has stated that employers can choose from one of the following when determining an end date for its reporting period:
The employer can select a date in the current year between July 1 and August 31 that represents the end of a payroll period.
The employer can use December 31 of the previous year if the employer has approval from the Equal Employment Opportunity Commission to use December 31 as the submission date for its EEO-1 reporting.
Employers with multiple establishments must submit a separate VETS 4212 report for each establishment.
The VETS 4212 report requires information on the number of protected veterans employed during the relevant reporting period as well as the total number of all persons employed during this period. Information on employees must be reported by EEO-1 category. Employers must also provide information on the total number of protected veterans and total number of persons hired during the reporting period. Finally, the VETS 4212 report requires information on the minimum and maximum number of persons employed during the reporting period.
