OFCCP Receives Extension Regarding Use of Disability Self-Identification Form

The U.S. Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) has received an extension on the use of its disability self-identification form. The site for the Office of Management and Budget's Office of Regulatory and Information Affairs shows that permission for use of the form was extended through May 31, 2026. The form previously had an expiration date of April 30, 2026.


As we have noted in a another blog, OFCCP has requested an extension of current data collection requirements for the two laws that the agency enforces. These laws are Section 503 of the Rehabilitation Act (Section 503) and the Vietnam Era Veterans Readjustment Assistance Act (VEVRAA). The use of the disability self-identification form developed by OFCCP is required under regulations associated with Section 503. The form must be offered to:


  • Applicants during the pre-offer stage of the employment process

  • Applicants during the post-offer stage of the employment process

  • Employees at least once every five years


It seems likely that the Office of Management and Budget (OMB) will do a monthly extension of OFCCP's data collection requirements and the requirement to use the current disability self-identification form until one of three things happens:


  1. OFCCP's proposals to modify its Section 503 and VEVRAA regulations are approved by OMB;

  2. OFCCP postpones its proposed regulatory changes and OMB approves a longer extension to current data collection requirements; or

  3. OFCCP's activities are transferred to another agency within the federal government.
